ADGM Dispute Resolution Hearing Centre (DRHC) & CEDR

Information for Applicants

  1. Persons who wish to be considered for inclusion in this panel must:
    1. demonstrate a substantial level of experience as a mediator; a minimum of 20 mediations or 200 hours of mediation practice in the three years preceding the application will normally be sufficient;
    2. provide proof of training and accreditation as a mediator by a reputable professional mediation training organisation that as a minimum meets the IMI ‘Certified Mediator Training Programme’ standard;
    3. demonstrate experience mediating international commercial disputes with State parties and Investor/multinational parties;
    4. demonstrate strong familiarity with the Investor-State Dispute System context including Bilateral Investment Treaties, IS Arbitration and the nature of the parties in an IS Dispute.
      This can be demonstrated by:
      1. experience mediating IS Disputes;
      2. experience as counsel or arbitrator in an IS Dispute;
      3. training in ISDS and IS Mediation; and
      4. substantial engagement in ISDS with International Investor State institutions;
    5. demonstrate cross-cultural training and/or experience and sensitivity, preferably having mediated cross-cultural disputes;
    6. be familiar with complex process design considering the various stakeholders involved in Investor State disputes, as well as the co-mediation process;
    7. set out details of other relevant mediation activities or accomplishments (e.g. providing mediation training or workshops, coaching or mentoring, achievement of honours and/or awards, publications, etc.);
    8. demonstrate commitment to continuous development through training and education; and
    9. confirm that the applicant has never been found guilty by a court or disciplinary tribunal of misconduct and is of good standing and character.
  2. The ADGM DRHC and CEDR reserve the right, in their absolute discretion, to accept for inclusion in the Panel applicants who do not meet all of the selection criteria listed in paragraph 1, but who are able to demonstrate a level of mediation experience that is commensurate with the standing and reputation of the members of the Panel.
  3. Applicants must complete and sign this application and attach the required documents.

  4. Applicants will be informed in writing as to whether their application is accepted. If the application is accepted, a summary profile of the applicant will be published on the ADGM DRHC and CEDR websites along with a link to the panel member’s resume.
  5. Inclusion in the Panel is for a fixed term of three years. It is recommended that applicants who have been accepted for inclusion in the Panel maintain a mediation practice of the highest standards and keep current with developments in the law and practice of mediation.
  6. The ADGM DRHC and CEDR will retain the applicant’s information for the purposes described in this application. For more information about how the respective institutions handle the applicant’s personal data, please refer to ADGM’s and CEDR’s Privacy or Data Protection Policy.
  7. The ADGM DRHC and CEDR reserve the right, in their absolute discretion, to:
    1. accept or reject applications for inclusion in the Panel;
    2. automatically review a mediator’s term on the Panel;
    3. refuse to renew a mediator’s term on the Panel; and
    4. remove a mediator from the Panel for any reason.
  8. Any decision made by CEDR and ADGM pursuant to paragraph 7 is final and is not subject to review. The ADGM DRHC and CEDR are under no obligation to provide reasons for any decision made pursuant to paragraph 7.
